Welcome to CholaPassTrek.com. These Terms and Conditions govern bookings, participation, and use of services offered through this website.
All trekking programs advertised on cholapasstrek.com are organized and operated by Himalayan Leisure, Inc. (“Himalayan Leisure”, “we”, “our”, or “us”), the parent company responsible for logistics, guides, safety, and operations.
By booking a trip through this website, you agree to the following terms.
1. Booking Confirmation
A booking is considered confirmed when:
- The completed booking form is submitted
- The required deposit payment (20% of total trip cost) is received
- You receive written confirmation from Himalayan Leisure
We reserve the right to decline any booking at our discretion.
2. Deposit and Payment
The deposit is 20% of the total trip cost and can be paid by:
- Debit or credit card (primary method)
- Alternative methods arranged upon request
The balance payment can be paid:
- On arrival, or
- Before arrival by cash, bank transfer, PayPal, Wise, Revolut, or debit/credit card
Please note:
- Our bank may charge up to 4.5% card processing fee for balance payments made by card.
- Other bank or transaction fees are the responsibility of the customer.
3. Cancellation Policy
Cancellation by Customer
If you cancel your booking:
- Cancellation up to 60 days before the tour start date: eligible for full refund minus incurred expenses (e.g., flights, permits, etc.)
- Cancellation within 60 days of the arrival date: deposit is non-refundable
Cancellation by Operator
Cancellation by Himalayan Leisure due to insufficient participants is only applicable for group tours.
In case of operator-initiated cancellation, customers may choose:
- A full refund, or
- Transfer to another departure date
We are not responsible for additional expenses caused by:
- Bad weather
- Domestic or international flight cancellations
- Strikes, natural disasters, or other unforeseen events
4. Trip Changes and Flexibility
Himalayan Leisure reserves the right to:
- Modify itineraries
- Change accommodations
- Adjust transportation
- Alter routes
These changes may be required due to safety concerns, weather, government regulations, or natural events. Our priority is always safety and the best possible trekking experience.
5. Travel Insurance
Travel insurance is highly recommended but not compulsory. If a participant does not have insurance, they must pay for any medical or emergency expenses in cash or bank cards. Himalayan Leisure is not responsible for any costs incurred.
6. Health and Fitness
Participants must:
- Be in good physical health
- Inform us of any medical conditions
- Follow the guide’s safety instructions
High-altitude trekking involves risks such as Altitude Sickness (AMS). Himalayan Leisure may require a participant to descend or leave the trek for their own safety. No refunds will be issued for early trek termination due to personal health issues or for any other decisions made by the client.
7. Guide Authority
The lead guide’s decisions are final regarding safety, routes, weather response, and participant health. Participants must comply at all times.
8. Assumption of Risk
Adventure travel involves inherent risks, including altitude illness, weather hazards, terrain hazards, transportation delays, and natural disasters. By joining a trek, participants acknowledge these risks and accept personal responsibility.
9. Liability Limitation
Himalayan Leisure, Inc., its employees, guides, contractors, and affiliates shall not be liable for injury, illness, death, loss of personal belongings, delays, or actions of third-party providers. Liability is limited to the amount paid for the trip.
10. Passports, Visas, and Travel Documents
Participants are responsible for obtaining valid passports, required visas, and vaccinations. We are not responsible for issues arising from incomplete documentation.
11. Personal Equipment
Participants are responsible for bringing appropriate trekking gear, including clothing for high-altitude conditions, footwear, and personal medications. Equipment lists are provided prior to the trek on request. Some basic gears such as down jacket, sleeping bag, trekking poles etc. might be provided by Himalayan Leisure, Inc. upon receiving a request from the customer.
12. Environmental Responsibility
We follow Leave No Trace principles. Participants must respect local culture, protect natural environments, and avoid littering. Serious violations may result in removal from the trek.
13. Photography and Media
Himalayan Leisure may use photographs or videos taken during trips for marketing, website content, and social media. Participants who prefer not to appear must inform us in writing before the trek.
14. Website Information
While we strive for accuracy, Himalayan Leisure does not guarantee that all information on cholapasstrek.com is error-free. We reserve the right to update trip prices, correct mistakes, and modify content.
15. Governing Law
These Terms & Conditions are governed by the laws applicable to Himalayan Leisure, Inc., and any disputes shall be resolved under the appropriate jurisdiction of Nepal.
